These terms and conditions apply between you, the User of this Website / Service (including any sub-domains, unless expressly excluded by their own terms and conditions), and Mentally Well Schools Limited trading as Mentally Well Schools, the owner and operator of this Website and Service. Please read these terms and conditions carefully, as they affect your legal rights. Your agreement to comply with and be bound by these terms and conditions is deemed to occur upon your first use of the Website and Service. If you do not agree to be bound by these terms and conditions, you should stop using the Website and Service immediately.

In these terms and conditions, User or Users means any third party that accesses the Website / Service and is not either (i) employed by Mentally Well Schools Limited trading as Mentally Well Schools and acting in the course of their employment or (ii) engaged as a consultant or otherwise providing services to Mentally Well Schools Limited trading as Mentally Well Schools and accessing the Website in connection with the provision of such services.

You must be at least 18 years of age to use this Website and Service. By using the Website and Service, and agreeing to these terms and conditions, you represent and warrant that you are at least 18 years of age.

Intellectual property and acceptable use

All Content included on the Website, unless uploaded by Users or expressly attributed as Curated Content, is the property of Mentally Well Schools Limited trading as Mentally Well Schools. In these terms and conditions, Content means any text, graphics, images, audio, video, software, data compilations, page layout, underlying code and software and any other form of information capable of being stored in a computer that appears on or forms part of this Website, including any such content uploaded by Users. By continuing to use the Website you acknowledge that such Content is protected by copyright, trademarks, database rights and other intellectual property rights. Nothing on this site shall be construed as granting, by implication, estoppel, or otherwise, any license or right to use any trademark, logo or service mark displayed on the site without the owner’s prior written permission.

You acknowledge that the product you use and download will remain the property of Mentally Well Schools Limited trading as Mentally Well Schools at all times and you agree to our Terms and Conditions of Use.

You may, for your own personal or school use only, do the following:

• • retrieve, display and view the Content on a computer screen, and print
  • Free Resources (excluding Programme Sample downloads): use and print our resources for your personal/classroom/homework/CPD (Continuing Professional Development) use, and/or share with colleagues in your school (or group of schools) or organisation for their personal/classroom/homework/CPD use – without altering the resources in any way, and always giving credit to Mentally Well Schools as the author of the resource. Note: Some of our Free Resources are freely shareable on social media, where explicitly stated.
  • Free Programme Sample downloads: peruse the materials within your school or group of schools but not use them to teach, or as part of staff INSET or other training/CPD sessions
  • Individual Plan subscribers: individual teachers or school counsellors may use and print our programme resources for your sole personal and/or direct use with students you directly teach or counsel for the duration of your subscription only; and sole individual use of our Staff Mental Health & Wellbeing Programme materials for the duration of your subscription only (school counsellors may use the Staff Mental Health & Wellbeing Programme materials with staff who you directly counsel)
  • School Plan subscribers: use and print our programme resources for use within your specific school or group of schools for the duration of your subscription only (Note: If a subscription is taken for a group of schools, all schools in the group must be clearly stated when signing up for a subscription.)
  • CPD Training Resources excluding DfE assured Senior Mental Health Lead Training course: use our CPD (Continuous Professional Development) training resources, Content and any recordings of our workshops within your school only (or in your group of schools – where the workshop was booked for a group of schools)
  • DfE assured Senior Mental Health Lead Training course: each course attendee may use the Staff Mental Health & Wellbeing Programme videos and PDFs for their own individual use only, and only for the duration of the course. All other handout materials given to attendees on the course may be shared with colleagues in their schools.

CPD Training discount for members

10% discount on CPD training for School Annual Plan subscribers (maximum 10% off per training session booked). There is a 20% discount for School Annual Plan subscribers who attend the DfE quality assured Senior Mental Health Lead Training course.

Individual Plan subscribers are also eligible for 10% off CPD training booked by their schools (maximum 10% off per training session booked). There is a 20% discount for Individual Plan subscribers who attend the DfE quality assured Senior Mental Health Lead Training course.

Registration

You must ensure that the details provided by you on registration or at any time are correct and complete.

You must inform us immediately of any changes to the information that you provide when registering by updating your personal details to ensure we can communicate with you effectively.

We may suspend or cancel your registration with immediate effect for any reasonable purposes or if you breach these terms and conditions.

You may cancel your registration at any time by informing us in writing to the address at the end of these terms and conditions. If you do so, you must immediately stop using the Website. Cancellation or suspension of your registration does not affect any statutory rights.

Password and security

When you register on this Website, you will be asked to create a password, which you should keep confidential and not disclose or share with anyone.

If we have reason to believe that there is or is likely to be any misuse of the Website or breach of security, we may require you to change your password or suspend your account.

Refusal of service

The Services are offered subject to our acceptance of your order or requests. We reserve the right to refuse service to any order, person or entity, without the obligation to assign reason for doing so. Where payment has already been taken, we reserve the right to cancel a subscription within 30 days of payment, and we will issue a full refund.

We reserve the right to remove the accounts held by any individuals representing companies that offer a similar or directly competing Service.

Order confirmation

We will email you to confirm the placement of your order and with details concerning product delivery and ongoing payments. In the event that there is an error in this email confirmation, it is your responsibility to inform us as soon as possible.

Duration of subscription agreement & 1-month Free Trial offer 

Once confirmed, we will provide you access to the purchased Service. You agree and understand that access to the Service may at times be influenced and affected by third parties that we use to provide the Service (web hosting, membership site plugins, etc.). You agree and understand that no breach of contract action may be initiated against Mentally Well Schools Limited when there are reasonable delays in the access of the Service.

Mentally Well Schools Limited reserves the right to terminate the Service, and or access to certain features of the Service, with or without prior notice to you. We will make reasonable efforts to provide notice but is not required to do so under the terms of this agreement.

The 1-month Free Trial promotional offer is available periodically, and is available only to new users.

Please note: If your subscription is cancelled within the 1 month free trial, you are not permitted to use our programme materials beyond that month. 

Valid form of payment required at sign-up, but you will not be charged until your first month free (30 days) period has completed, and you may cancel at any time. You will need to cancel before the end of the first month (30 day) period if you do not want to be charged. To manage or cancel your subscription, visit the Account section within your logged in user Dashboard.

After first month (30 day) free period: 

For Annual Plan subscriptions, you will receive 365 days access. You may cancel the automatic renewal of your annual subscription at any time from within the Account section of your Dashboard, and your access to the Site will end at the end of the current contracted term.

If you are paying on a Monthly Plan subscription, this allows you access to the Service for 30 days. Failure to pay your monthly subscription payment will result in access to the Service being stopped. You may cancel the automatic renewal of your monthly subscription at any time from within the Account section of your Dashboard, and your access to the Site will end at the end of the current contracted term.

Lifetime Access is for the lifetime of the Service. If for any reason, Mentally Well Schools Limited should dissolve or cease to exist, then your access to the Service terminates.

Purchase Order payments

Upon receipt of the fully completed form & a copy of your Purchase Order, we will process your order and set up your Mentally Well Schools subscription within 5 working days for your use. We will also send an invoice to the Accounts Department contact as provided on the form. Payment terms: Invoice to be paid within 30 days of invoice date. An email reminder will be sent if payment is not received within 30 days of the invoice date. We reserve the right to remove the accounts of users where there is non-payment after 50 days of the invoice date.

Cancellations and Refunds

We offer a 14-day no quibble money back guarantee at the start of your subscription. The 14-day money back guarantee does not apply to subscription renewals.

Beyond the first 14 days, you may cancel your Monthly subscription at any time via your Account page but due to the nature of the Service, no refunds will be made for any membership fees already paid.

Once you cancel you will no longer have access to the Service, including all content and community resources, once your current membership period is completed.

No partial refunds are given should you terminate an Annual subscription before your renewal date, however you will retain access to the Service until the end of your annual payment term.

Note: It is entirely your responsibility to ensure that you cancel your account in good time should you no longer require the Service and do not wish to be billed further.

2. Our programme content is drip-fed on a monthly basis from your subscription start date. Upon purchasing your subscription, you will receive immediate access to the first 4 weeks of the available programmes. After 30 days, you will receive access to the next few weeks of programme content. In the case of newly published programmes, we reserve the right to drip-feed the content: 4 weeks of new programme content is usually released initially, and the remaining weeks of new programme content are published in the weeks that follow.
3. Your use of the Service is at your sole risk. Mentally Well Schools Limited trading as Mentally Well Schools has made every effort to ensure that the Content on the Website and made available through the Service is accurate and up-to-date and correct at the time of publication. However, the Website and the Service are provided on an ‘as is’ and ‘as available’ basis. As stated in our FAQs section, our resources and programmes are designed to help teach children, young people and staff in schools a range of evidence-based mental health skills which have been shown in various studies to benefit mental health. Our materials are designed as a more general PSHE resource or as a targeted intervention for children about whom you have SEMH (Social, Emotional and Mental Health) concerns. However, the resources, programmes and service we offer are not intended as a substitute for counselling/psychotherapy sessions, or for an assessment with an Educational Psychologist; nor are they a substitute for any other face to face interventions with a trained mental health professional.
8. Mentally Well Schools is not responsible for how the Content on the Website or available through the Service is used, is interpreted or what reliance is placed on it. We do not accept any responsibility for the results of any action taken on the basis of the information provided on the Website or available through the Service.
